Is there fraud by Simyo against users?

I have just been charged €400 for data above my cap - I received a message warning me that I had hit my usage cap only 20 minutes before my account was blocked.  If Simyo is able to block the account when it becomes a credit risk you are able to block it immediately.  Leaving the default setting that consumers are able to run up hundreds of euros of charges for services which carry a tiny marginal cost for Simyo and are forced to discover this the hard way before applying an opt-in block is a predatory practice and I would consider it very close to fraudulent behaviour.  This is clearly a deliberate practice judging by the many, many instances of this discussed in this forum.  I suggest that Simyo reconsiders this practice before a class-action suit is launched against you.

Thank you for your message. I understand that you are shocked by these high costs. 

I see that ​@wimj12 already gave you some information about our Genereal Terms and Conditions. To avoid extra costs we always send two warning messages. One at 80% usage of the internetbundle and one when the bundle is fully used. If no action is taken after these messages you will pay €0,15 per MB. We will block the simcard when the costs are at €100,- but the costs can always be more because consumption is always processed with a delay.

I also advice you to take a data cap. You can not make extra costs then. 

Can you send me a private message with your personal information? Then i will have a look at your subscription to see if we can do something about the costs.

Did you read the General Terms and Conditions (Algemene voorwaarden) before making the agreement with Simyo? As a lawyer, you should do that.

And you should have taken a “dataplafond” or cap in your subscription.

This is just a user forum, and people, which are just as you, subscribers from simyo, do not like your tone.
