EXTREMELY high out of bundle bill for during 15 mins

Dear Simyo Customer Service,

I am contacting you regarding the recent out-of-bundle data charge of €700 on my account. According to your usage report, 4,667 MB of data was consumed between 5:42 AM and 5:58 AM . I would like to clarify this, as such usage in just 16 minutes seems highly unusual.

For context:

  • I received an 80% usage warning at 11:00 PM the previous night.

  • I received a final out-of-bundle warning at 5:42 AM .

  • From 5:42 AM to 5:58 AM, the bill shows €700 at €0.15 per MB.

Could you please provide clarification on:

  1. The exact session logs for this period (including timestamps and data amounts per minute).

  2. The network type (EU / non-EU) that the data was used on.

I would appreciate a detailed explanation, as I need to understand how this charge was calculated.

Thank you for your message. I’m sorry to hear that extra internet usage caused charges outside your bundle. I understand that this is frustrating and not what you expected.

We always send two warning SMS messages: one when your internet bundle reaches 80% usage, and one when the bundle is fully used. Once your internet bundle is depleted and you continue to use data, the out-of-bundle rate of €0.15 per MB applies. As ​@Groentjuh mentioned, you can set a Dataplafond with us to prevent high out-of-bundle charges.

Our system records data usage per session, with a maximum of approximately 59 MB per session. For example, if you use 200 MB, it will be split into multiple sessions of roughly 59 MB. All usage you see is directly recorded from the network, and the information in the app matches what we receive. Due to privacy regulations, we cannot see exactly what the data was used for.

I would advise checking if your device automatically switches from Wi-Fi to mobile data when the Wi-Fi signal is weak. On some devices, this feature is called “Smart Network Switch” or “Wi-Fi Assist.” Also check if automatic backups, such as iCloud Drive or Google Drive, are enabled, as these can use a lot of MB over 4G/5G.

You could also install a “Data Manager” app to track how many MB each app uses. Internet usage counts both incoming and outgoing data toward your total usage.

Could you please send me a private message with your phone number and personal details? This way, I can discuss your situation internally with the relevant department and explore what options are available for a suitable solution.

That would likely be data within the Netherlands as Simyo would need to cap data costs to 50 euro excl VAT (60,50 incl VAT) while roaming.

If you do not have a data plafond, Internet using Simyo will just continue at full speed, but charged €0,15/MB. 4667 MBs outside your data bundle gets you 700,05 euro.

I would recommend enabling that data plafond bundle, because it prevents precisely this issue. Data usage would have been blocked when the data bundle ran out.

I would advise you figure out what app has been using a lot of data on your phone. Possible this blog helps you do that.

The information Simyo shown in Mijn Simyo is basically what they get themselves from the network of KPN. The KPN network groups data usage of 60MB or data usage of a period of 8 hours together into one line you can see in Mijn Simyo. This is why you likely see a bunch of 60MB sessions in Mijn Simyo. This is just the network splitting it that way. In reality it was probably all one and the same thing. 700MB in 16 minutes could easily be some video stream accidentally left on while falling asleep. Quick math says it was 5,83 Mbit/s.

Thank you for your detailed explanation. However, I still strongly disagree with the conclusion.

Based on the data provided in my account, my daily usage patterns are extremely consistent and low. For example, in the days before this incident, my usage ranged between 28 MB and 438 MB, with the exception of one day where I used Wi‑Fi heavily. Nothing in my usage history indicates that I ever consume gigabytes of mobile data in minutes.

On March 19th, however, the system suddenly shows:

  • 6,356 MB consumed,
  • mostly through repeated entries of exactly 59 MB,
  • recorded multiple times per minute,
  • each charged at €8.79.

This pattern is clearly visible in the screenshots I attached and is not normal user behaviour. It looks like automated billing segmentation rather than real user activity. The claim that this was “one accidental video stream” does not explain:

  • why the system logged dozens of identical 59 MB blocks,
  • why they were timestamped within seconds of each other,
  • and why this occurred at a time when I was not using my phone at all.

I would also like to emphasize that according to your own logic:

  • 59 MB charged at €8.79 implies ~€0.15 per MB,
  • but the frequency and repetition of these blocks raise serious questions about the accuracy of this registration.

At this point, I am requesting:

  1. A full technical investigation into the source of these repeated 59 MB entries.
  2. Clarification on why such entries appear every few seconds, which is not consistent with normal data consumption.
  3. Escalation to a department with access to deeper technical logs, as the default “network grouping explanation” does not address the issue.
  4. An official statement if Simyo/KPN is unable to provide more detailed data than what appears in Mijn Simyo.

Given the magnitude of the charges (€689.64 in minutes) and the discrepancy with my typical consumption, I cannot accept the assumption that this is normal behaviour. If this matter cannot be resolved transparently, I will proceed with submitting a complaint to the ACM so the registration method and billing accuracy can be reviewed.

Why was the data not capped at €100?

Under EU regulations, mobile data outside a bundle must trigger a €50 (ex VAT) / €60 (incl VAT) mandatory data cap unless the customer explicitly opts out.
Even domestic mobile data typically follows the same protective mechanism to prevent excessive billing shocks.

I did not disable this protection, and I was never warned that:

  • I reached €60,
  • I reached €100,
  • or that my data would continue at €0.15/MB without any limit.

Given this, I need a clear explanation of how my bill was allowed to reach nearly €700 without any automatic block. This alone indicates a failure of the protective measures that should legally be in place.

I expect a more thorough follow‑up.

Also, there are 2 different amounts of 254.93 EUR which refers to high costs outside your bundles and its different than on the invoice. Can we clarify it too?

I do not know why previous usage would change anything. "I normally never speed!” would not prevent someone from speeding some other time when he/she is in a hurry.

In your case something on your phone did use 6356MB. That's annoying if that happens. It can be lots of things doing that. Updates, backups, falling asleep with a video on or even some mobile virus-protection app suddenly going mad like here. If you can, please review the app data usage using your phone's own data-counters instruction that may help can be found here. Android actually logs data-usage per app! iOS also does that, but does not periodically reset the counters, so this data is less useful to figure anything out.

As I tried to already explain: KPN's network automatically splits ALL data usage into parts that are either ~60MB (therefore you see all those 59MB entries!) or 8 hours long (when using little data you will see frequently 3 entries a day).

So you would download a 200 MB update, you would see that as 3 entries of 60 MB at that time.

If you downloaded it fast at the maximum speed of 300 mbps, those 3 entries would be just 1,6 seconds apart. If you download is slow, then those would be further apart. KPN nor Simyo logs precisely what you did. They only bother how much data you used for billing.

Would you really want an ISP knowing what apps you use, what websites you visit, what videos you watch, etc, etc? ISPs could make good money collecting that and then selling such data to advertisers, but sadly for them that isn't allowed!

Once again, see if your phone's OS can help you better figure out what app used all that data!

Those EU regulations only apply while roaming. You were connected to KPN/Simyo's own network on which those regulations do not apply.

Simyo offers protective mechanisms. It is called “Data plafond” and costs 0,50 euro/month. It is not enabled/selected on your account. In my post a recommended to enable it, so this will not happen again.

Simyo also offers “Hoog verbruik”, which likely stopped your bill from going even higher than the 700 euro that you have now. That systeem sadly is processing usage with a slight delay (technical reasons), so you can easily exceed its limits if you have high usage in a small amount of time.

There is no legal limits preventing this situation.

Was it connected to Wifi?

700 euro @ 150 euro/GB would be about 4.6 GB. I wonder what app on the phone used that much data.

Could it have been an OS update?

 

Note that the amount of data usage is highly likely to be correct, even if it’s highly unexpected and undesirable.

The charges are still ridiculous.
